Privacy Policy

SECTION 1 - GENERAL INFORMATION 

This Privacy Policy states how the company collects, uses, shares, handles, processes, and protects data collected from this websites users and visitors. It aims at being absolutely transparent about this subject and explicitly describe to all interested parties how and why data is collected, and how users can manage or delete their personal information. 

This Privacy Policy applies to all users and visitors to this site, and is a part of its General Terms and Conditions. 

This document was crafted in compliance with the General Data Protection Law (Brazilian law 13.709/18), the Brazilian Civil Rights Framework for the Internet (Brazilian law 12.965/14) and the EU Regulation n. 2016/6790. We reserve ourselves the right to modify or update this Privacy Policy to keep it current and up-to-date according to new advancements in current laws; therefore, we encourage users to check this document periodically. 

 

SECTION 2 - HOW WE COLLECT PERSONAL DATA FROM USERS AND VISITORS 

The platform collects personal data from users and visitors the following ways: 

  • When users create their accounts/profiles in the platform: This is basic personal identification data, such as: e-mail, full name and address, phone number, and ID number. From this data, we can properly identify users and visitors, and provide them with better security to meet their needs. Users and visitors are aware that their profiles/accounts can be accessed by all other users and visitors in the platform as well. 
  • When users and visitors access the website: This information, regarding access and interaction, is collected by Elipse Software to provide a better experience to all users and visitors. It includes, but it is not restricted to: keywords used for searches, shared documents, comments, page views, profiles, original URLs, browser, and access IP, among others that can be stored and retained. 
  • Via third parties: The platform can receive third-party data (e.g. via Facebook or Google) when users log in with their personal accounts at said services. Data usage is previously authorized by users at the third party. 

 

SECTION 3 - WHICH PERSONAL DATA WE COLLECT FROM USERS AND VISITORS 

We collect the following personal data from users and visitors in our platform: 

  • Basic personal identification data in order to create the account/profile in the platform: e-mail, full name and address, phone number, and ID number. 
  • Data for browsing optimization: access to pages, keywords used for searches, recommendations, comments, interaction with other account/profiles, followed profiles, IP address. 
  • Data for executing financial transactions: billing information such as credit card numbers and PIN codes, in addition to any payments already made. 
  • Newslettersthe e-mail registered by the user to subscribe to the newsletter service will be collected and stored until the same user opts out of the service. 
  • Sensitive personal information: race, ethnic origin, political opinions, religious or philosophical beliefs, genetic information, health concerns, sexual orientation. 
  • Data regarding contracts: upon finalizing purchase or service rendering agreements between the platform and the user/visitor, data regarding contractual execution can be collected and stored, including any communication exchanged between Elipse Software and the user. 

 

SECTION 4 - WHY WE USE PERSONAL DATA FROM USERS AND VISITORS 

We collect personal data from users and visitors and store it in our platform for the following purposes: 

  • Well-being of users and visitors: data can improve the product/service being offered; promote, optimize, and fulfill the agreements established between user and company; enhance user experience; and offer customized features to meet the users basic needs. 
  • Improved platform: data can help understand how users utilize the platform and therefore support them to develop their businesses and practices. 
  • Addsdata will direct personalized adds to the user according to their needs. 
  • Salesdata will help personalize the offered content and subsidize the platform to improve the quality of services being provided. 
  • Projecting user profiles: automated personal data handling will help evaluate the how the platform is being used. 
  • Access to registered data: helps create areas in the platform that are restricted to registered users only. 
  • Contract data: provides all parts with legal security and facilitates closing the deal. 
  • Data for other purposes not listed here in this Privacy Policy will only be handled upon prior notice the user, so that the rights and obligations provided herein remain applicable.  

 

SECTION 5 - HOW LONG THE PERSONAL DATA WILL BE STORED 

Personal data from users and visitors are stored in the platform for as long as the service is being rendered, or to comply with the purposes intended in the present document, as seen in paragraph I of article 15 of Brazilian law 13.709/18. 

Data can be removed or anonymized upon request by the user, except in cases where the law states otherwise. 

Moreover, personal data from users can only be stored after the conclusion of one of the following hypotheses listed in the article 16 of the aforementioned law:  

 I - completion of legal or regulatory requirement by the controller; 

 II - study conducted by research organ, as long as anonymization of personal data is ensured;  

 III - transfer to a third party, as long as the data handling requirements prescribed in this Law are respected; 

 IV - exclusive use by the controller; access by third parties is forbidden; data must be anonymized. 

 

SECTION 6 - SECURITY OF STORED PERSONAL DATA 

The platform is committed to putting technical and organizational security measures in place in order to protect personal data from unauthorized access and from situations that present any threat of destruction, losses, alteration, disclosure, or spread of this data. 

Data pertaining credit cards is encrypted with "secure socket layer" (SSL) technology, which ensures data is transmitted safely and confidentially, so that data transfer between server and user is encrypted and protected. 

The platform does not limit its liability relating to third-party incidents (such as hackers or crackers attacks), nor to user-caused ones (when they personally transfer their data to other parties). The site is committed to notifying the user in case of any security breach of their personal data. 

Any personal data stored in our platform is confidential, within legal limits. However, we may disclose your personal information if requested by law, or if you violate our Terms of Service. 

 

SECTION 7 - DATA SHARING 

The platform will only share data that the user has posted publicly and shared with other users. 

Personal information will not be shared publicly by the platform in any search system. 

 

SECTION 8 - WILL SHARED PERSONAL INFORMATION BE TRANSFERRED TO THIRD PARTIES? 

Each third-party service provider, such as payment transaction processors, have their own privacy policy. Therefore, we recommend an attentive, thorough read of their policies to ascertain which type of personal data can be used by those providers. 

Providers can either be a local company or ventures headquartered in different countries. In the latter case, shared personal information may be subject to local jurisdiction from where the provider or its facilities are based. 

Whenever you access our services and provide us with your information, you are consenting to the processing, transfer, and storage of said information in other countries. 

When you are redirected to a third-party app or website, you are no longer under this platforms Privacy Policy or Terms of Service. We are not responsible for the privacy policies in other websites, and we encourage you to read their own statements on privacy regarding their services. 

 

SECTION 9 – COOKIES OR BROWSING DATA 

Cookies are text files sent by the platform to the user/visitors computer which are stored in it with information pertaining site browsing. This information contains access data such as time and place, and are stored in the user/visitors browser so that the platforms server can read it afterwards in order to customize the services on the platform. 

The user/visitor acknowledges and accepts that a browsing data collection system can be employed via cookies. 

Persistent cookies remain in the user/visitors hard drive after closing the browser, and can be used by this browser in further visits to the site. This type of cookie can be removed per the browsers instructions. Section cookies, on the other hand, are temporary, and will disappear once the browser closes. You can set up your web browser to reject all cookies; however, some resources in the platform may not work correctly if cookies are disabled. 

 

SECTION 10 - CONSENT 

By using our services and providing personal information to the platform, the user consents with the present Privacy Policy.  

The user, by registering in our platform, demonstrates to be aware of their rights, and they are entitled to cancel their register at any time, to access their personal data and keep it updated, and to vouch for the accuracy of the information made available by them. 

The user has the right to withdraw their consent at any time; to do so, they must contact the company via a formulary placed on the sites footer. 

 

SECTION 11 - CHANGES TO THIS PRIVACY POLICY 

We reserve the right to change this Privacy Policy at any time; therefore, we recommend the user to revisit it periodically. 

Any changes or additional clarifications to this policy are effective immediately upon publication in the platform. When they take place, users are notified in a timely manner. By using the website or adding any new information to it after being aware of the changes, users and visitors indicate they agree with new regulations expressed in this document. 

If the company is involved in a merger, acquisition, or sale of assets, user information can be transferred to the new owners to ensure service continuity. 

 

SECTION 12 – JURISDICTION OF CONFLICTS RESOLUTION 

To settle any disputes in the present document, Brazilian laws will fully apply. 

Occasional legal litigations must be presented to the district court where the company is headquartered.
